Terms of Service
1. About these terms
These terms are an agreement between you and Billz Pty Ltd [ACN / ABN to be added] ("Billz", "we", "us") about your use of Billz, our invoicing software. By creating an account or using Billz you agree to them. If you use Billz for a business, you confirm you are allowed to agree on that business's behalf.
2. What Billz is
Billz helps you create quotes and invoices, send them, and keep track of what has been paid. Billz is a tool. It is not an accountant, a bookkeeper, a tax agent or a lawyer, and nothing in Billz is tax, legal or financial advice.
QuickBillz turns a sentence you type into a draft invoice. It makes suggestions, and you check and confirm them. It can get things wrong, so look over every invoice before you issue it.
Billz does not handle your customers' payments. Customers pay you directly, for example by bank transfer, and you record the payment in Billz.
3. Your account
- You must be 18 or over, and give us accurate details.
- Keep your password safe. You are responsible for what happens under your account, including by people you invite.
- Tell us straight away at [support email] if you think someone else has got into your account.
4. Your invoices and your data
Your records belong to you. You are responsible for the content of your invoices and quotes, for charging GST correctly, for the accuracy of your ABN and bank details, for keeping your own records as the law requires, and for having a proper reason to hold your customers' details. Billz does not check any of these.
You give us permission to store and process your data, and to send emails on your behalf when you ask us to, only so we can provide Billz. How we handle personal information is explained in our Privacy Policy.
5. Acceptable use
You must not use Billz to:
- break the law, or invoice for work or goods that do not exist;
- send spam or messages to people who have no connection with you or your business;
- attempt to get around limits, break into other accounts, or interfere with how Billz runs;
- copy, resell or reverse-engineer Billz.
To protect the service we limit how many emails an account can send each day. We may pause an account that is being used in breach of these terms.
6. Plans and billing
Billz has a free plan and a paid plan. The current features, limits and prices are on our pricing page. New accounts start with a free trial of the paid plan (30 days), with no card required. If you do not add payment details by the end of the trial, the account moves to the free plan and nothing is charged.
Paid plans are billed monthly in Australian dollars, and prices are shown without GST, which is added where it applies. You can cancel at any time. You keep the paid features until the end of the month you have paid for, then the account moves to the free plan. We will give you at least [30] days' notice before changing a price.
7. Ending your account
You can stop using Billz and ask us to close your account at any time. Download what you need first, because closing an account deletes your data as described in the Privacy Policy. We may close or suspend an account that breaks these terms, and will tell you why where we can.
8. Availability
We work to keep Billz running, but we do not promise it will always be available or free of errors. We may change or remove features over time. We will try to give notice of any change that significantly affects you.
9. Our responsibility to you
Nothing in these terms limits any right you have under the Australian Consumer Law or other laws that cannot be excluded. Subject to that, and to the extent the law allows, Billz is provided "as is", we are not liable for indirect or consequential loss, or for loss of profit or data, and our total liability for anything arising from the service is limited to the amount you paid us in the 12 months before the claim [lawyer to confirm]. Where the law allows us to limit our liability for a failure to meet a consumer guarantee, we limit it to resupplying the service or paying the cost of having it resupplied.
10. Intellectual property
Billz, including its software, design and name, belongs to us. You get a personal, non-transferable right to use it while these terms apply. Your content stays yours.
11. Changes to these terms
We may update these terms. For changes that matter we will tell you by email or in the app before they take effect. If you keep using Billz after that, you accept the new terms.
12. General
These terms are governed by the laws of [State], Australia, and the courts of [State] have jurisdiction. If part of these terms is found to be unenforceable, the rest still applies. Questions about these terms: [support email].
